Federal immigration authorities arrested a Brazilian national in Virginia after discovering he was operating a commercial vehicle without the commercial driver’s license required by law, according to ICE.

U.S. Immigration and Customs Enforcement announced the arrest of a Brazilian citizen who was allegedly driving a commercial truck on Interstate 81 without the proper commercial driver’s license credentials.

ICE’s Homeland Security Investigations office in Harrisonburg reported the administrative arrest of Lins Dos Santos-Melo during an enforcement operation conducted on May 27 in Virginia.

According to federal authorities, Dos Santos-Melo was operating a vehicle and trailer combination that legally required a Commercial Driver’s License (CDL).

Massachusetts License Did Not Authorize Commercial Operation

Investigators said Dos Santos-Melo possessed a valid Massachusetts driver’s license but did not hold a CDL, which is required for the type of commercial vehicle he was driving.

Federal officials did not disclose where along Interstate 81 the stop occurred or whether additional violations were discovered during the investigation.

ICE also stated that Dos Santos-Melo was unlawfully present in the United States at the time of his arrest.

ICE Highlights Commercial Vehicle Safety Concerns

Acting ICE Director David J. Venturella said commercial licensing requirements are designed to protect motorists and ensure operators receive specialized training before driving large vehicles.

“Commercial driver’s license requirements exist for a reason,” Venturella said. “When someone gets behind the wheel of a vehicle this size without the training and qualifications required by law, they’re putting every family sharing that roadway at risk.”

Venturella added that Dos Santos-Melo allegedly lacked both the legal authority to remain in the country and the legal authorization to operate the commercial vehicle.

Arrest Follows Other High-Profile Trucking Cases

ICE noted that the arrest comes amid increased scrutiny of commercial vehicle operators who lack proper licensing or legal status.

Federal officials referenced several recent cases involving commercial drivers, including an April arrest connected to a fatal crash that killed a newlywed couple and a separate Indiana crash investigation in which four people died.

Authorities did not suggest Dos Santos-Melo was involved in any crash or traffic fatality.

Debate Over Licensing Policies Continues

The case also highlights ongoing debate over state licensing policies.

Massachusetts began issuing standard driver’s licenses regardless of immigration status under the Work and Family Mobility Act, which took effect in 2023.

However, federal regulations continue to govern eligibility requirements for commercial driver’s licenses.

ICE officials said they will continue working with law enforcement partners to identify individuals who violate immigration and transportation laws.

The agency encouraged members of the public to report suspected criminal activity through its national tip line.
