Eldens is still authorised and supervised by us. The firm must still comply with our rules. The Joint Administrators are now responsible for the firm’s affairs and must act in the interests of the firm’s creditors. This includes customers whose items, known as pledged assets, were used as security for pawnbroking loans and are still held by Eldens.
The Joint Administrators are authorised to act as licensed insolvency practitioners by their authorising body (The Institute of Chartered Accountants in England and Wales). The Joint Administrators are officers of the court and are required to comply with all insolvency law.
As the regulator of Eldens, we will continue to engage with the Joint Administrators to seek the appropriate outcomes for customers.
All existing loan agreements remain in place and will not be affected by the administration. However, the firm is no longer able to issue new loans.
The Joint Administrators are now responsible for the firm and will assess the status and location of all assets. Please contact them for further information about your item.
The Joint Administrators will provide more information.
If a customer does not repay a pawnbroking loan, the pawnbroker may be entitled to sell the item (pledged asset) used as security for the loan.
If a pawnbroker sells a customer’s pledged item because the loan has not been repaid, it can only keep enough from the sale to cover the amount the customer still owes. This includes the outstanding loan amount, plus any interest and charges that are properly due, and any costs associated with the sale. If the item sells for more than this amount, the extra money is called surplus proceeds and should be returned to the customer.
Please contact the Joint Administrators for more information if you believe your item has already been sold due to missed loan repayments, and you think you may be entitled to a surplus.
You should contact the Joint Administrators. They will provide details of how complaints and claims will be handled.
If your complaint is already with the Financial Ombudsman Service, please contact them by logging into the portal on their website or calling their helpline on 0800 023 4567.
Generally, there is no FSCS cover for consumer credit lenders, which includes pawnbroking firms. The FSCS can be contacted directly on 0800 678 1100 or via their website.
