The lawyer for the woman shot five times by a Border Patrol agent has called for his immediate suspension after he boasted that he would do it again.

Charles Exum, of Calais, Maine, texted colleagues 'I'm up for another round of f**k around and find out,' the day after the shooting in Chicago.

'The fact he's not suspended is crazy,' said attorney Christopher Parente, a former federal prosecutor.

'Why would you put a guy who's telling you that he's looking forward to shooting people back with a firearm in a situation like that?' he added.

'To me that's completely reckless.'

Parente's client Marimar Martinez, 30 was shot after a collision between Exum's government-issued Chevy Tahoe and two other vehicles, one of which she was driving.

Exum had been sent to the Windy City as part of President Trump's program to round-up people who are in the country illegally.

'No law enforcement wakes up and wants to shoot people,' lawyer Parente told the Daily Mail.

Chicago native Marimar Martinez, a Montessori teacher, was shot five times by border patrol agent Charles Exum on October 4, following a collision involving the two and another driver

Screenshots of text messages obtained by the Daily Mail show the agent boasting about how many times he shot her, stating he was ready for 'another round of f*** around and find out'

The agent sent an article about the incident to an unidentified person, telling them to read it – seemingly bragging that he fired seven shots and struck her five times

Martinez's lawyer, Christopher Parente, told the Daily Mail that the 'crazy' part of the case is that Exum has escaped suspension and is already back on armed duty

'This guy is saying he's looking forward the next round of f**k around and find out. To me the fact CBP is putting him back out in some other city with an assault rifle is shocking.'

However, US Customs and Border Protection has since allowed agent Exum, who has worked border patrol for two decades, to return to duty.

Exum, who has worked border patrol for over two decades, shot Marimar Martinez five times on the southwest side of the Windy City on October 4, following a collision between the two and a separate car driven by Ian Santos Ruiz, 21, according to officials.

Martinez, 30, and Ruiz, 21, were charged with assault on a federal officer using a deadly or dangerous weapon.

However, Martinez claims that it was the agent who sideswiped her.

'Our position is that he swerved into her lane, and I think that's consistent with the body camera video that I've seen,' Parente told the Daily Mail.

He claimed his client presented no threat.

'She's a US citizen with no criminal history, a Montessori school teacher who was on her way to drop off a bag of clothes to donate at her local parish on a Saturday morning when this all happened,' he said.

In another text, Exum wrote 'I have a MOF amendment to add to my story. I fired five rounds, and she had seven holes – put that in your book boys,' later telling a judge that 'MOF' stood for 'Miserable Old F**ker'

Martinez and the other driver, 21-year-old Ian Santos Ruiz, were charged with assault on a federal officer using a deadly or dangerous weapon and taken into custody by the FBI

He also boasted about getting his '15 mins of fame', telling the judge his reasoning behind sending the texts in the first place stemmed from taking pride in his shooting skills as a firearms instructor

At a hearing in Chicago on Wednesday, Exum's texts on a private Signal chat, disclosed to the defense, became topic number one.

The texts show Exum sent a news article from the Guardian about the shooting and urged his colleagues to 'Read it. 5 shots, seven holes.'

'I have a MOF amendment to add to my story,' he added in the exchange. 'I fired five rounds, and she had seven holes. Put that in your book, boys.'

Facing questions at the hearing, Exum explained to US District Judge Georgia Alexakis that a MOF is a 'Miserable Old F**ker' that is always trying to outdo others.

When asked by Parente why he sent the texts, Exum replied: 'I'm a firearms instructor, and I take pride in my shooting skills.'

A day after the shooting, Exum had sent another message that read: 'Cool. I'm up for another round of 'f**k around and find out.'

Apparently yukking it up with colleagues, whose comments are redacted, he also wrote: 'S**t happens,' 'Lmao' and bragged about his '15 mins of fame', the texts show.

In court, Exum defended his use of force: 'I did what I had to do,' he said, contending that his life was at risk, according to the Chicago Sun-Times.

None of the officers sustained serious injuries.

Speaking with the Daily Mail on Friday, Parente said the text exchange offer a disturbing window into the mindset of certain border agents at a pivotal time, as the Trump administration carries out 'Operation Midway Blitz,' detaining illegal immigrants all across the windy city while facing protests on the street.

'People want to know what these border patrol agents are thinking,' Parente said.

'This is what he's texting to other border patrol agents on an encrypted app. So why are a bunch of border patrol agents using Signal, bragging about shooting US citizens, and then saying they're looking forward to the next one.

'That's alarming to me just as a citizen.'

Apparently joking with colleagues whose replies were redacted, Exum also wrote 'S**t happens' and 'Lmao,' according to the texts

The CBP vehicle that Martinez's lawyer alleges sideswiped her car. Parente said that from the body camera footage he saw it appeared Exum 'swerved into her lane'

Border patrol agents and Chicago police officers talk along Kedzie Avenue in the Brighton Park Neighborhood as Federal Agents were investigating a shooting on October 4 – the day Martinez was shot five times

A person is detained as residents of Chicago's Brighton Park neighborhood confront US Border Patrol and other law enforcement officers at a gas station, after ICE agents took a man into custody from his car on October 4 in Chicago

The Department of Homeland Security, commenting on the shooting  said when the agents exited their vehicle, 'a suspect tried to run them over, forcing the officers to fire defensively'.

DHS spokesperson Tricia McLaughlin said Martinez was armed with a semiautomatic weapon, according to the Boston Herald.

Martinez was treated at the hospital and was taken into custody by the FBI after her release.

On Wednesday in court, Parente argued that the agency destroyed evidence after allowing Exum to drive his SUV from Chicago back to his station in Maine, where the scratches and marks were buffed out.

Exum told the court that he was 'told to pick it up, I picked it up.' After it was processed and released by the FBI.

However, Judge Alexakis questioned why Martinez and Ruiz's vehicles were kept in Chicago as evidence while the agent's was released.

'What gives me great pause is the fact that the cars have been treated differently,' Alexakis said.

The judge ordered the government to return the agent's vehicle to Chicago on a flatbed truck, according to CNN.

Illinois Gov. J.B. Pritzker and Chicago Mayor Brandon Johnson have pushed back against sending armed troops into the city.

Despite their efforts, Trump has attempted to deploy the National Guard to the city, a decision now being reviewed by the Supreme Court to determine if the deployment is fair.

Estimates indicate Chicago is home to approximately 150,000 illegal immigrants, accounting for about 8 percent of households.
