The Malaysian Communications and Multimedia Commission (MCMC) is still working with the Domestic Trade and Cost of Living Ministry (KPDN), Finance Ministry (MOF) and Customs Department to finalise the regulatory framework for cross-border e-commerce platforms. The framework is intended to establish clearer rules for these services while ensuring a more level playing field for local businesses.

Deputy Communications Minister Teo Nie Ching said MCMC has the authority under Malaysia’s existing legal framework to license e-commerce platforms, but is waiting for the relevant ministries to provide the terms and conditions that will govern the licensing process. She said MCMC is ready to proceed once the framework and necessary instructions are in place.

Speaking to reporters after the media launch of the ASEAN-China Cross Border E-Commerce Expo 2026 (CBE2026) at the Kuala Lumpur Convention Centre, Teo said discussions with KPDN and MoF are ongoing. She added that KPDN is studying how cross-border e-commerce platforms should be regulated, while MCMC is involved because of its existing licensing powers.

The move comes amid concerns from Malaysian retailers over the impact of cross-border e-commerce platforms offering products at ultra-low prices, including China’s Pinduoduo. However, Teo stressed that the regulatory exercise is not aimed specifically at that platform or any other individual platform.

“But again, this is not just targeting Pinduoduo, it’s all the e-commerce platforms,” she said. “We want to level the playing field and make sure that Malaysian consumers are protected.”

Teo also said MCMC would work with the relevant authorities on product safety and compliance, as the commission does not determine whether individual products meet specific safety or technical standards. Instead, enforcement would fall under the agency responsible for the particular product category.

For example, she said medicines that require approval from the Health Ministry should not be sold through an unauthorised platform. For other products, such as tyres, the relevant authority would be responsible for determining whether they comply with Malaysia’s applicable standards.

The licensing framework is therefore expected to involve multiple government agencies, with MCMC handling the licensing aspect while other ministries and authorities determine requirements relating to trade, taxation, customs and product compliance. However, details on the final terms and conditions, as well as when the licensing requirements will take effect, have yet to be announced.
