Combat sports gear company fails to take domain through cybersquatting claim.

AI mega-investor James Booth has successfully defended one of his .ai domain names.

Do or Die, Inc, d/b/a/ Hyperfly, filed a dispute (pdf) with World Intellectual Property Organization against Booth’s domain hyperfly.ai. Hyperfly sells combat sports gear.

The three-person panel found that the complainant failed to show that the domain was registered and used in bad faith.

It noted that, “…there is no evidence that the Respondent specifically targeted the Complainants’ mark…”

The panel also pointed out that while Hyperfly might be a well-known brand in the martial arts community, many other parties use the name for other goods and services.

It concluded:

The evidence on record suggests that the Respondent, on balance of probabilities, registered the disputed domain name as part of a broader batch acquisition of multiple potentially valuable domain names in the AI space, and was selected for its perceived commercial or brandable value as combination of two ordinary English words with substantial independent commercial appeal across multiple industries, without specifically targeting the Complainants.

The panel declined to find reverse domain name hijacking.

Hyperfly was internally represented. Ankur Raheja of Cylaw Solutions represented Booth.
