On this basis, and the fact it’d received no complaints from owners of affected vehicles, the automaker petitioned the NHTSA to dismiss the violation as being “inconsequential” to vehicle safety. However, the government body explained that while the headlights may not throw direct glare at other road users, they could still cause “veiling glare,” from light scattered off water droplets, snowflakes, or other particulates in the air. It was this argument that pushed the NHTSA to force Tesla to recall the affected vehicles.

Tesla has yet to figure out a remedy for the problem, however; it’s presumed the headlights will need to be either replaced or modified with some sort of mask or shield to cut down the excess light. In any case, this is not a problem Tesla can fix with a software update.
